These Terms of Service ("Terms") constitute a legally binding agreement between you and BSCALE SOFTWARE DEVELOPMENT SERVICES ("Company," "we," "us," or "our") concerning your access to and use of the Para Po! mobile application (the "App").
By creating an account or using Para Po!, you agree to be bound by these Terms. If you do not agree to these Terms, you must not access or use the App.

You must be at least 13 years of age to use Para Po!. By using the App, you represent and warrant that you meet this age requirement. If you are between 13 and 18 years old (or the age of majority in your jurisdiction), you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.
To use Para Po!, you must create an account by providing a valid email address. You agree to:
While we do not prohibit account sharing, you acknowledge that you are solely responsible for all activities conducted through your account, including those by others you allow to access it.
Para Po! is a GPS-based alarm application that allows users to set location-based alarms. The App tracks your real-time location when an alarm is active and notifies you when you approach your designated destination.
Para Po! is currently in an early testing phase. Users may be invited to participate in beta testing or early access programs on an invite-only basis. Beta testers acknowledge that:

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the App for your personal, non-commercial use.

Violation of these restrictions may result in immediate termination of your account and potential legal action.
The App and its entire contents, features, and functionality (including but not limited to all information, software, code, text, displays, graphics, photographs, video, audio, design, presentation, selection, and arrangement) are owned by BSCALE SOFTWARE DEVELOPMENT SERVICES and are protected by Philippine and international copyright, trademark, patent, trade secret, and other intellectual property laws.
"Para Po!" and the Para Po! logo, along with all related names, logos, product and service names, designs, images, and slogans, are trademarks of BSCALE SOFTWARE DEVELOPMENT SERVICES. You may not use these marks without our prior written permission. All other names, logos, product and service names, designs, and slogans are the trademarks of their respective owners.
Any destination coordinates, preferences, or other data you input into the App ("User Content") remain your property. However, by using the App, you grant us a worldwide, royalty-free license to use, store, and process your User Content solely for the purpose of providing and improving the App, in accordance with our Privacy Policy.
If you provide us with any feedback, suggestions, or ideas about the App ("Feedback"), you grant us an unrestricted, perpetual, irrevocable, worldwide, royalty-free right to use, modify, and incorporate such Feedback into our products and services without any obligation to you.
If you believe any content in the App infringes your intellectual property rights, please contact us at support@bscale.tech with detailed information about the alleged infringement.

YOU ACKNOWLEDGE AND AGREE THAT YOU USE PARA PO! AT YOUR OWN RISK AND SHOULD NOT DEPEND ON IT AS YOUR SOLE METHOD FOR WAKING UP, NAVIGATION, OR TIMING CRITICAL ACTIVITIES.
Para Po! is currently in early testing and development. The App may contain bugs, errors, incomplete features, or other issues that could affect functionality. WE STRONGLY ENCOURAGE YOU TO USE THE IN-APP REPORTING FEATURE TO REPORT ANY ISSUES, BUGS, OR PROBLEMS YOU ENCOUNTER.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
IF, NOTWITHSTANDING THE OTHER PROVISIONS OF THESE TERMS, WE ARE FOUND TO BE LIABLE TO YOU FOR ANY DAMAGE OR LOSS, OUR TOTAL LIABILITY SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRIOR TO THE EVENT GIVING RISE TO LIABILITY, OR (B) ONE HUNDRED PHILIPPINE PESOS (PHP 100.00).

You agree to defend, indemnify, and hold harmless BSCALE SOFTWARE DEVELOPMENT SERVICES, its officers, directors, employees, agents, affiliates, and partners from and against any and all claims, damages, obligations, losses, liabilities, costs, debts, and expenses (including attorney's fees) arising from:

Your continued use of the App after any changes constitutes your acceptance of the revised Terms. If you do not agree to the revised Terms, you must stop using the App and may terminate your account.
We encourage you to review these Terms periodically to stay informed about your rights and obligations.
These Terms and your use of the App shall be governed by and construed in accordance with the laws of the Republic of the Philippines, without regard to its conflict of law provisions.
You agree that any legal action or proceeding arising out of or relating to these Terms or the App shall be brought exclusively in the courts located in Cavite, Philippines. You consent to the personal jurisdiction of such courts and waive any objection to venue in such courts.
Before filing any formal legal claim, you agree to first contact us at support@bscale.tech to attempt to resolve the dispute informally. We will attempt to resolve the dispute informally by contacting you via email. If a dispute is not resolved within sixty (60) days after submission, you or we may bring a formal proceeding.
If both parties agree, disputes may be resolved through binding arbitration conducted in accordance with the rules of the Philippine Dispute Resolution Center, Inc. (PDRCI) or another mutually agreed arbitration body. Arbitration shall take place in Cavite, Philippines, and the decision of the arbitrator shall be final and binding.
Arbitration is optional and requires mutual consent. Either party may choose to pursue claims in court instead.
YOU AGREE THAT ANY DISPUTE RESOLUTION PROCEEDINGS WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. This means you cannot bring a claim as a plaintiff or class member in a class action or representative proceeding.
If this class action waiver is found to be unenforceable, the entire dispute resolution section shall be null and void.
Notwithstanding the above, either party may seek injunctive or other equitable relief in any court of competent jurisdiction to protect intellectual property rights without first engaging in informal resolution or arbitration.
These Terms, together with our Privacy Policy, constitute the entire agreement between you and BSCALE SOFTWARE DEVELOPMENT SERVICES regarding the App and supersede all prior agreements and understandings, whether written or oral.
If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such provision shall be modified to the minimum extent necessary to make it enforceable, or if that is not possible, severed from these Terms. The remaining provisions shall remain in full force and effect.
Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. No waiver of any provision of these Terms shall be deemed a further or continuing waiver of such provision or any other provision.
You may not assign, transfer, or delegate these Terms or your rights and obligations hereunder without our prior written consent. We may freely assign or transfer these Terms and our rights and obligations hereunder to any third party without restriction or notice to you. Any attempted assignment in violation of this section shall be null and void.
We shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, earthquakes, pandemics, internet outages, or disruptions to third-party services.
These Terms are written in English. If these Terms are translated into another language, the English version shall prevail in case of any inconsistency or discrepancy.
The section headings in these Terms are for convenience only and have no legal or contractual effect.
These Terms do not and are not intended to confer any rights or remedies upon any person or entity other than you and BSCALE SOFTWARE DEVELOPMENT SERVICES.
By using the App, you consent to receive electronic communications from us, including emails, notifications, and messages posted on the App. You agree that all agreements, notices, disclosures, and other communications we provide to you electronically satisfy any legal requirement that such communications be in writing.

You agree to comply with all applicable export and import control laws and regulations in your use of the App. You may not use or export or re-export the App except as authorized by Philippine law and the laws of the jurisdiction in which you obtained the App.
The following sections shall survive termination of these Terms: Intellectual Property Rights, Disclaimers and Limitation of Liability, Indemnification, Dispute Resolution and Governing Law, and any other provisions that by their nature should survive.

Para Po! is currently provided free of charge. However, we reserve the right to introduce paid features, premium subscriptions, or in-app purchases in the future.

You are never obligated to purchase paid features. If you choose not to purchase, you may continue using available free features or terminate your account.
